Zoning commission hearing for May 15th

has an excused absence so next item on
the agenda is the Pledge of Allegiance
commission like to lead

um to the audience we had a study
session prior to this and I do have a
couple of cards one
on item number
four Jeff
Miller um say in favor of the item do

St uh good evening my name is Jeff
Miller work with the Arizona Liquor
industry Consultants uh we represent Mr
fio on the Forum there were just a few
questions that I want to make myself
available nothing has changed ever since
the last approval of 22 um they've never
had a complaint for loud music at at all
city's been great you guys have all been
great to work with um he's just want to
give up
a instead of staying open to till 9 or
till 10:00 during the week he's going to
reduce it down to staying open at 9
hoping that appeases the neighbors I I
reviewed and looked at the chart about
the distances I mean as a crow flies
it's like 63 miles away and there's a
ton of houses in between this location
um and and those houses and it's even
got AC cross Gilbert Road and in in the
letter that they even said it's like
this has potential for problems so it's
not even complaining about anything
that's happened in the past it's just
looking that future problems and the fos
are are are great neighbors great in the
community in fact they built this to
have a community center where you know
businesses can come there in interior um
have trainings open it up to the
residents uh special event stuff it
hasn't been a problem and they're
willing to work with the neighbors any
of them and I got off the phone with the
owner and the owner said hey if we need
to give my personal number if there's
ever you know a noise complaint he he'd
address it specifically so I just wanted
to let you guys know really is willing
to be a good neighbor and he appreciates
um your guys time on this he just wants
to continue doing his business thank you
I've been at the facility it's a nice
facility so and there hasn't been any
complaints and there there's
stipulations in this thing if to keep
the noise and if somebody does have a
complaint I know he'd be really good
with the neighbors as well so yes sir

yes good evening thank you my name is
Terry Smith I'm the Chief Operating
Officer of Arizona Priority Care uh we
are the uh the anchor tenant the largest
tenet in one of the two Office Buildings
in this project the 585 building uh
we've been there for eight years leasing
space uh we've got three different
Suites on the two floors that they have
in that building 32,000 Square ft we
have 110
employees uh and we're a we're a
Chandler based business for the last 13
years
um we uh Arizona Priority Care is a
large Medical Group we have over 4,000
Healthcare Providers a network of of
those providers across the state uh I
want to point out that this particular
space though is our corporate space
right these are corporate buildings the
500 the 585 historically corporate
office space not medical office space uh
and that's really big for us so the
ownership of this of these buildings
changed in the last year and a half to
two years new owners are the ones
requesting the
rezoning uh and they're wanting to make
it a medical office building that whole
Corridor is all administrative or
corporate office building um and we've
got uh concerns with that and so we're
opposed to this resoning I me the
biggest reason is it's fundamentally a
different type of use of the building as
a real material change from from
administrative or corporate type office
space to introducing patient flow
patient care clinical space patients
coming into the building whether it be a
physician office a medical group a
clinic a Counseling Center these are all
patient care uh settings and they belong
in my opinion they belong in a medical
building and that's not what this has
been these don't mix well usually if you
have uh tenants uh that have
historically been in a building it's an
administrative building and you bring in
medical practices you're probably going
to chase them away I can speak for our
organization we want corporate space and
it's unfortunate that you know if you
were to approve this and they follow
through and introduce Physicians into
this office we would likely not renew
the lease and move and that's really
unfortunate you know we've been in
Chandler we've been this office for
eight years uh and I hate to see that
kind of disruption but that's what can
happen when you mix the use like this
and bring in physici offices to what's
been the corporate center and the key
thing there is the uh you know patient
flow patient coming in the lobby looking
around for their office up and down the
hallways the restrooms but a constant
flow of patients in and out and that's
very different use than than what's
typically there uh the other thing I
want to mention there are 32 different
Medical Specialties you know you you've
kind of set aside four here that would
be excluded but there's 28 others so
there's a lot of uncertainty around what
types of Specialties could be in the
building so that's that that's uh
something I think we're pointing out
here as well again I think all patient
care and that and that setting is very
disruptive and finally I want to bring
up mental health because that's
something that the uh I think is being
recommended mental health is a very big
concern uh there's such a wide range of
diagnosis around patients needing
behavioral health or mental health
treatment counseling you know it can be
court order treatment it could be anger
management it could be drug addictions
there's a whole host you couldn't you
know couldn't sit here and list them all
but I don't believe that it belongs
inserted into a corporate building like
this there's also a a public safety
issue around this these buildings back
to a public park they back to Desert
Breeze Park there's a walkway to the
park sports teams practice there there's
an elementary school and a middle school
adjacent to this property does it really
sound like a good idea to approve mental
health counseling and treatment across
from a public park and from these
schools I would say the general public
would say no that's a really bad idea
it's I just want to go on record to
saying I think there's a risk there and
you should really take that into
consideration so again finally I think
this all would translate to disruption
if they're able to bring in medical
practices um I can only speak for this
tenant but we're a big tenant we're the
big tenant in the building and um you
know that type of disruption and and
being forced to leave or look for space
elsewhere is probably the outcome so

just so I make sure I'm understanding
um you are located in the 585 building
I'm sorry you're located in the 585
building the 585 correct okay thank you
and staff this request is for Tennessee
in the 500 it's for 500 and 585 it's
kind of label as 500 here but it's both
buildings uh through the chair uh vice
mayor it would be for both of the
buildings okay thank you and just got a
promotion to vice mayor so thank you Ben
you're welcome I'm not sure that the
real vice mayor will be very pleased
with that but thank you I appreciate and
thank you for your
yes staff do you have any comments on
that on the different buildings I'm just
going to jump in real Qui uh yes Mr
chairman uh when staff receives a
request to allow medical uses into an
existing building we review the requests
through um the lens of what kind of
potential impacts there might be on the
site and on neighboring properties so
for example uh traffic parking um things
of that nature um for that reason staff
is proposing as you know a stipulation
that would limit the types of medical
uses um So currently the the both
buildings allow for general office um to
be um and to occupy those spaces and
that parking required for the general
office is one space per 250 square feet
if we were to allow all medical uses um
there are certain types of medical uses
as was mentioned before that that can be
more intense and would require more
parking and might possibly create a
parking situation where there there'd be
uh parking spilling over onto the
streets and onto adjacent properties and
so we don't want that to happen so staff
is proposing to limit the types of
medical uses to u to those that are not
as intense and the way we're doing that
is by requiring a parking study for any
medical use that might come before us at
the time that they request a tenant
improvements permit that's when we would
review we would ask them to submit a
parking study we would review it to make
sure that they are not exceeding one
space for 250 square fet so that it it
remains to be compatible with the office
that was approved originally on that
site so that that is the lens through
which uh staff is reviewing and
recommending approval of this
request
