make wow it's like I'm in church the holy hush descends over the building Welcome to our regular meeting of the Chandler city council we're having some audio questions up here that are going to be resolved but until then I'll be using Andor passing this mic to make sure that we can be heard and recorded and all that wonderful stuff as I mentioned I would like to call this meeting to order clerk please take the role here here very good our invitation tonight will be brought forth by Pastor Keith Shepard uh certainly a friend of the Cities from Church of Christ on Alma School and our pledge allegiance by council member Poston let's pray together please holy God we thank you for the life that you've blessed us with we thank you for life at this time in this place we pray your blessings father on this city those who work for it those who live here we thank you Father for our country we pray for our country we pray for all of our leaders national state and local we pray and know that you give power to whoever you wish we pray you bless these servants that they may honor you and serve the people we pray father for the police and the firefighters and all the First Responders we thank you Father for for your grace and mercy that's been with us in the past and we pray for your mercy for we are a sinful people but you sent your son that we would have hope we pray again for your grace to continue to give us peace and prosperity and blessing If It Be Your Will we pray for peace in the world we thank you again father for all things in Jesus name we pray amen please join me in the Pledge of Allegiance I pledge allegiance to the flag of the United States of America and to the rep for IT stand naice thank you Pastor thank you council member although we don't have many scheduled public appearances the ones we have are large so we're excited to move into that portion of our meeting and I'd like to invite vice mayor Ellis to join me up front all right our first scheduled public appearance is Chandler Unified School District Arizona College Prep Hamilton High School and Castile High School all named to advanced placement high uh School honor Ro so I'd like to invite up uh representatives from cusd uh Frank nuchi superintendent uh ACP School Rob uh bicks hope I got your name right okay uh chrisy Ludwig High School site assessment facilitator and from Hamilton High School Dominic Romero as principal we want to thank you all for joining us this evening to to acknowledge and recognize the great things going on in cusd and our Chandler Community we're proud of the students who are here in Chandler and of the incredible schools that are available to our families three of our high schools being named to the AP honor Ro is just one example of academic Excellence that is being provided by our Chandler schools and uh Frank why don't you give us some more details and share some on this sure thank you mayor council thank you very much for the honor and also our city our city staff who support us endlessly in high schools it's very competitive and as you know we have many ways and Pathways for kids to get to to to different Pathways one's academic in college and so our kids will either take dual credit or they'll take AP which is advanced placement or they'll even take IB over a channel High School International Borat so there's many options and different roads for families to take this schools that are being recognized tonight have done an exceptional job Nationwide of providing more access so that more students are equably treated that they can all learn and they can all advance and that it's not filtering kids out but we're pumping them through and providing them opportunity the other area to that they're being recognized is that they have high completion rates of kids scoring high three or higher in that in in on the AP tests or there's some kids that have even taken five AP tests in through the course of of a year and so those numbers are just not heard of in in most districts but in Chandler it's a common place especially at these three high schools our other high schools would be up here too but there's dual credits that many parents choose at the end of the day all it matters is that parents your kids are going into a college a college of their choice a destination of their choice as a matter of fact during our college recruitment Fair we had colleges from across the nation that wanted to recruit Chandler students um but it also provides you a cost savings Advantage when you're putting your children through college because it's very expensive Endeavor uh by taking these AP credits or these dual credit credits with them so again it's a these are two principles here along with Mr J snitker over at Castile do an amazing job you guys want to add anything to that we just obviously appreciate the support the city gives to Chandler schools and we're so excited and happy that we have an opportunity to work with your your children every single day and see the success that they bring to our schools our efforts are displayed by their achievements and so it's fantastic to see their accolades put us in the spotlight the way they do so thank you for being a part of Chandler schools no I just want to thank the mayor and the city for the support it truly is the kids that we are producing at um CD are going back into this community and hopefully grow in it and continue to be the place where people want to be so I appreciate the parents and the support because these schools wouldn't be around without you guys so thank you all right we're going to take a photo don't go anyway and I know from the city side whenever we talk in Economic Development what sight Seeker looking for are a really great education for families and kids and I would say that our relationship with cusd and the other schools in our community is really part of our secret superpower that helps attract great companies and and keeps people here because who doesn't want to live in a safe community that has a pathway forward to prosperity for them for their kids thank you for being part of our secret sauce of Chandler let's do a photo all right thank you all all right uh next got ahead of myself all right I don't know whether you had the opportunity to join us in December but at our annual Parade of Lights and tumble weed tree lighting we had such an amazing time there were great floats uh an excellent time just a great vibe that night and I'd like to call up hermalinda yamus and we would like to recognize the winners in our parade good evening mayor and Council I'm hermalinda yamas the special event senior program manager and it's my honor to recognize the 200 uh 24 Parade of Lights winners the Parade of Lights is a long-standing tradition for the city chanler many families organizations schools and businesses attend and participate each year we are excited to present the winners of the 2024 pra of lights and thank them for all their hard work and participation tonight we will recognize eight winners from five different categories we will have representatives from each of the winning groups come forward when their name is announced and accept their reward our first category is best lit musical or dance group and we had two entries tie for first place now in my 17 years this is the first time it's happened so it's always um fun to see when those first take place our first place our first first place group in best lit music and dance group goes to Just Dance and accepting the reward tonight is Debbie Debbie cantillo the performance and competition teams of this local dance school demonstrated their sweet moves with their Candyland theme float for all to see congratulations J dance and at the end if we can have everyone come back up one is overwhelming you're ambitious but we can do it all right all right our next first place group in best lit music musical and dance group goes to motivating movement creative and accepting the award tonight are Alyssa Danielle and Sadi Carlile these dancers range in age from two from two through adults and they had the prayed audience wanting to move right along with them congratulations motivating movement creative moving on to our next category best lit community group second place was awarded to Santan elementary school elementary student council and accepting their award on their behalf is bran price and Danica Schroeder [Applause] this group wanted to keep things traditional and had lovely blue and white lights snowf snowflakes and snow globes you can hear them sing their Christmas carols as they drove past you in the parade congratulations santen Elementary student council all right first place in best slit community group goes to Legacy Traditional schools and accepting their award the award on their behalf are Michelle tribal and Kim [Applause] Chapman the school and its students brought out all the stops with their float as they had lights banners and Bubbles they were sure to be a sight to be seen congratulations traditional like or Legacy Traditional schools thank you our next category is best lit business group our second place winner is British Swim School and although they are unable to be here tonight we appreciate and thank them for their participation and enthusiasm in the Parade of [Applause] Lights our first place in best lit business group goes to stars in Motion Dance School and accepting their reward tonight is Caitlyn Williamson this Grinch them float was a can't miss attraction in the parade with dancers dressed up as who's from Whoville Cindy and the Grinch joined the community in the celebration congratulations stars and motion dance school the next category is always a favorite among our parade Watchers and parade participants biggest and brightest first place in biggest and brightest goes to Copper State four-wheelers and here to accept the award on their behalf is Jim nset and Ronald Silva Silva come on the club was formed in 1972 by a group of families to promote safe and enjoyable family style four willing and lucky for us they chose to bring four 14 lit up four-wheelers to chanler this past year for all to en Joy congratulations Copper State four-wheelers all right our final award for the evening is judge's choice and it goes to Just Dance and accepting their award on their behalf is Debbie cantillo come on back up Just Dance also won our first place prize for best lit Musical and dance group but our judges love this float so much they voted them judges Choice congratulations Just Dance all right all right can we have all winners come back up for one big group picture come on you deserve it how about the you ladies there we go you you guys on so next on our agenda tonight is our the regular meeting consent agenda all the items that had been called in have been reconciled by private briefings so uh do we have a motion for our member Hawkins yes mayor heartkey yes motion Carri unanimously very good in Council we have one action item which is resolution number 5867 accepting the annual comprehensive financial report for the fiscal year ending June 30 2024 demonstrating compliance with Arizona revised Statute so this is mandatory that this is on action rather than consent staff good evening I'm Julie goer I'm the accounting senior manager and we're here tonight for uh resolution number 5867 the adoption of the annual comprehensive financial report and that's for our fiscal year ending June 30 2024 I'm pleased to introduce Joshua jumper he is from our audit firm hfield meech and he's going to be presenting the annual audit good evening everyone uh PowerPoint not on the TVs I don't see them but that's okay I don't know if it's on YouTube or not but I'll run through them like they are I don't know if you can see them but good evening uh mayor hary members of council uh City management it's my pleasure to be here this evening and uh discuss the audit results for the fiscal year end June 30th 2024 uh I have some prepared remarks um some prepared slides but if you have any questions during my brief presentation don't hesitate to ask uh so why does the city require an annual audit uh so a few different reasons so City Charter and state statute require the city receive an annual audit on its financial statements additionally Federal Law requires the city to go undergo a single audit which is an audit of the federal dollars that the city receives additionally there's an AR that requires the audit results be presented in front of council outside of consent agenda uh which is another reason I'm here this evening and then additionally uh the annual comprehensive financial report the acfr that's the city's annual financial statements is posted online uh on the city's website so it wouldn't be an audit presentation if I didn't briefly discuss the importance of an annual audit uh so the annual financial statement audit verifies management representations on the financial statements they prepare you're demonstrating stewardship and accountability to a host of different entities and individuals whether they be the citizens you the governing body the council uh grant tours state agencies federal agencies uh Bond holders Etc uh it includes reviewing compliance with laws and regulations and then ultimately you're doing your duty to ensure management fulfills their responsibility uh so the audit process for this uh past fiscal year uh our audit procedures began in may we made four different on-site visits to the city uh onewe visits in July August October and November uh we also perform audit procedures remotely between those on-site visits and then audit reports were issued in December and January so what's included when we say the annual audit so there are uh various different audit related reports issued so the first one being the audit communication to those charged with governance so that's a letter directly to you the council uh I'll touch on that a little bit more in a minute uh but the main one the big one the annual comprehensive financial report uh the city's financial statements uh that's one of the that's the report we issue our audit opinion on again that single audit uh that gets issued to the Fed federal government it includes two different report on internal controls one under government auditing standards and then one on compliance with federal laws and awards additionally procedures related to the Arizona Department of Environmental Quality adq over landfill requirements Highway user Revenue fund herf monies those monies you receive from the state uh we issue a compliance report on those and then the city's annual expenditure limitation report uh so just again three key items from the fiscal year uh that I want to touch on uh the most important number one being the city received an unmodified audit opinion that was dated December 20th 2024 an unmodified opinion in non-accounting speak is a clean opinion uh so pleased to report that this evening additionally number two is good news as well no internal control deficiencies were noted not notated during the annual audit this year uh so if they if there were any we'd have to include those in the single audit that goes to the federal government but please report there were none and then number three just noting that uh the city continues to spend uh those covid-19 Grant monies that have been received in Prior fiscal years uh in fiscal 24 and it just requires audit attention and focus uh as the federal government deems those monies of importance to focus on from an audit perspective all right uh other important Communications so referencing that letter to governance so that's included in your agenda packet uh the main letters just three pages uh also included in that uh file is the engagement letter that's signed at the beginning of the audit management letter representation letter that's signed at the end of the audit that gives us approval to issue our audit opinion but that main three Page Letter just some uh highlights that are included in that letter uh we uh we're required to disclose if we had disagreements with management during the audit please to report there were none we're required to disclose if we had any difficulties encountered uh preventing us from concluding the audit there were none uh please a report there were no uncorrected statements either significant or insignificant no uncorrected misstatements and then additionally just there's verbiage in there regarding fraud not to alarm anyone but more just indicating the importance uh that ultimately responsibility for fraud within the organization realize with management and Council uh and uh yeah just in indicating the importance of that and reiterating the responsibilities that management and Council have that was a little longer than I was expecting but went over a a host of different things but ultimately those are my prepared remarks the audit went well uh we got what uh we needed from City management throughout the year to get our audit procedures completed um all audit reports have been issued and submitted on time as well throughout the year but if you have any questions for me as part of the audit process or anything including in the reports I'm happy to answer them thank you Mr jumper um any questions or comments for Josh jumper no I know we've encountered each other in the past as well as you did mags recently carries unanimously thank you and thank you all all right I do have two uh speaker cards for unscheduled public appearance and with our our unscheduled public speaker speakers this is not since this is unscheduled we cannot engage you we cannot have a conversation with you but we and staff hear your comments and staff will follow up uh as as necessary if necessary to uh further understand and report back to us our first Speaker card is from Paul pavich Mr pavish please your name and address and you have up to three minutes to share when that light turns yellow please uh consider wrapping up your comments great do we have we don't have a light do we all right so you got to be a beep or something at three okay excellent it's already started so I get five more seconds my name is Paul pavich I live at 1313 East heisen Street so members of the council my family our neighbors in the city of Chandler have been taken advantage of for years by the short-term rental operated by a nationwide management company at 1323 East Tyson Street I had renewed hope that with the April 13th 2023 unanimous adoption by the city council of chapter 22 short-term rental regulations the residents of Chandon would finally have a mechanism to hold Str Str operators accountable un unfortunately I've learned through countless hours of attempting to work with administrators in various offices from code enforcement to business compliance that chapter 22 simply appears to be for show verified violations include but are not limited to failure to notify neighbors prior listing property 22- 6.1 Falls attestation to obtain operating license 22 d3.5 C listing property without the required disclosures 22- 7.1 on multiple advertisements 22- 7.2 and others the city has the authority to revoke the license for 12 months solely based on the false attestation per 22-35 C and the city may also or also has the authority based on the three violation rule in 22- 3.5 or 22-9 these are only the Str Str violations if you consider the code enforcement violations the property has admitted to like converting a garage into an enclosed habitable space without a permit to increase the occupancy or you consider cost a law enforcement including but not limited to February trespassing March noise disturbance March trespassing July noise disturbance March noise disturbance April suspicious activity April noise disturbance November noise disturbance I think you get the picture despite this code enforcement case numbers 10267 and 10308 generated beginning August 8th 2024 are not resolved code enforcement closed the cases by transferring them to tax and Licensing tax and Licensing then pass them around within business compliance none of the individuals Within These departments have been responsive to my repeated requests for status updates or provided resolution in accordance with chapter 22 so unresponsive in fact that I had to submit public records requests to get updates about these cases I had to physically go to City Hall unannounced in order to have a discussion with them about it on November 19th I also attempted to physically go to a neighborhood advisory committee meeting to be heard only to learn that it was cancelled without notice to the public in closing the property has been operating on a business license that was obtained through falsified records since July 1st 2024 that's 206 days the business compliance office has been provided everything needed to enforce city code has refused to do so has provided non-resp responsive dismissive replies to my simple inquiries the operations of this major Nationwide property management company have been prioritized over Chandler residents for too long it is the city's obligation to penalize Bad actors and not look the other way I'm here because I do not know where else to go I've gone everywhere else in the city I've tried navigating the appropriate channels to no avail I'm asking for support and enforcing existing code and would love to meet with any of you who are willing to do so I've also provided some documentation to thank you Mr P for your availability thank you um Step I would and I'm sure Council would just like an update and a path to resolution for these concerns so share with us where we're at share with us how this is going to be reconciled we would appreciate that thank you council member Orlando yeah and as staff is looking into that I also like the S process I think it's fair for any individual that they know what the process is who's responsible what are the handoffs so how we get this resolved because you got two issues here so I'd like to see that as well thank you thank you thank you you C appreciate our next speaker is Jenny Vitali um Miss Vali you have up to three minutes please state your name and address and the and the mic is yours I don't even see the mic um for the Rec my name is Jenny Vitali I reside at 3321 North Nebraska Street that's in the old part of Chandler up north by the canal I'm here tonight because I emailed all of you in addition to John canson uh regarding the lovely letter we got uh that dealt with whether or not we have lead pipes and whether or not our neighborhood had to be analyzed I'm sure that you read your email and uh understood my frustration with that letter one of the problems that I have is that I understand that it's a a tricky Wicket Sometimes When government agencies have to play nice with each other so city of Chandler is under the jurisdiction of DEQ for their public water service and DEQ is under the direction of the EPA with regard to this lead service line inventory that we're embarking on the problem is this city of Chandler already embarked on a lead service line uh inventory back in 1992 EPA B baned lead pipes in 86 the state banned them in 88 and in 1992 city of Chandler went and did a lead service inventory and tried to identify who had Leed pipes in some of these older homes or galvanized pipe too that's already been done and so now we're being asked to effectively redo what we've already done when I talk to staff staff is prepared to tell you they have to spend up to $2 million to hire two subcontractors to go and pot hole on private property you are not allowed to pot hole on private property that is a violation of our fourth right Amendment it is a violation of the administrative search Doctrine unless you get a search warrant you really don't have a right to enter anybody's property when I talked to John can he said now we're going to try not to do that we're going to try and look in the water meter boxes and we're going to try and look at the hose bibs where the stop valves are for most people's homes most people don't even know what those are there Comes A Time and and the letter that went out by the way your city staff didn't write they didn't even like it and they didn't want to send it out they were dictated that letter by the EPA there comes a point where your city employees and you as a city need to sometimes tell an agency to go fly a kite and you need to sometimes tell an agency no we're going to do do it our way we're going to comply with your regulation but this letter is manure and we're going to actually put out a letter that informs our homeowners what it is we're doing and why we have to do it I've had tons of neighbors call me because apparently I'm the only one that comes to you guys and and speaks up for the neighborhood and say Jenny what does this letter mean what it means is they can enter your property and start digging up trying to find your waterline but what the letter doesn't say is that you as a homeowner have a right to refuse that what the letter doesn't say is what's going to happen if they're pot holing and accidentally hits your waterline why is that important I recently had my curb stop valve fail and I needed the water shut off so that I could fix a pipe in the backyard they couldn't get the water valves out in the street I still don't have my water valve put back together and they had to come out three times to fix it because they had to Liv stop it instead of spending $2 million on a goose chase that was already done in 1992 those resources need to be allocated for aging infrastructure you've got neighborhoods in which valves don't work and shut off anymore you've got uh valves that need to be replaced and homeowners don't know what is their responsibility versus the city's responsibility so please have a chat with your staff and John kuton and s in particular because I think they can Enlighten you as to some of the resources they need from you instead of lip service thank you m thank you Josh vice mayor thank you Josh I know that you had mentioned um this particular case to me because I had a question about it after I received that letter and so it is important that we go back now and backtrack and work something out I know agency to agency there might not be anything that we can do because we are under the law just like we have to abide by their laws also but at the same time if we could just look into how can we we reconcile anything between our neighbors that we live next door to and those state regulations that we have to deal with all h of tie we know that yeah thank you thank you vice mayor next on our agenda is current events uh Chandler Council and staff opportunities to share things happening or or highlight things so I'll start with coming up this weekend is the Chandler International Film Festival I am excited to announce that it's back again for another year at look theater in downtown Chandler this event kicks off tomorrow with a red carpet event and will run through February 2nd the Chandler International Film Festival will be showcasing over 120 films submitted from all around the world spanning from six continents in 35 countries including last year's Chandler state of the city video struthio the festival is dedicated to uniting the community Through film and whether you're a filmmaker a casual viewer there's something for everyone so come join us on the red carpet Opening Ceremonies tomorrow night and check out the full schedule of events at Chandler film festival.com secondly the the next day Saturday invite Council and our community to join me at the unity walk at annual 22nd annual Unity walk in Tempe Chandler and six neighboring communities will come together at tempy beach park in downtown Tempe this community-driven initiative is aimed at fostering a sense of unity and understanding amongst residents of Chandler and their neighbors the free event starts at 4:30 PM with a festival at tempy beach park and a one mile candlelight walk starting at 6m I look forward to being there and and hanging out with my Chandler Peeps and council members who will also join me and lastly I do want to invite you all for the um this year's February 13th state of the city address we will myself and Council will be there on Thursday February 13th we'll present the highlights of our community's accomplishments from the past years and look forward to 2025 there's going to be reception starting at 5:30 pm. where you can mingle uh sample food from some local Chandler restaurants enjoy a themed Lobby experience and then at 6:30 the formal remarks will begin for more information and the opportunity to RSVP so that we know we'll have enough food you can do this at chandleraz.gov stateof thee City all right council member Poston all right thank you mayor so I'm excited to have a few opportunities for our teens to get involved some leadership opportunities the very first one is that applications are now open for the teen Leadership Academy and that is for high school students that gives them a behind the-scenes look at how our city government operates this program takes place on March 14th and it is a fantastic opportunity for teens to explore the Civic leadership and learn how they can make a difference in Chandler what's really unique about this program and absolutely fantastic is that this is planned by teens for teens our mayor's youth commission works all year long to plan this event so we know it's going to be right up their alley and all the teens will enjoy it and then speaking of mayor's youth commission we are looking for teens who are interested in serving on this board they help advise mayor and Council about issues that are facing the teen community and help plan next year's Teen Leadership Academy those applications open on February 1st through March 31st and all chanler teens in 8 through 11th grade are eligible to apply and then finally our community services team will be hosting a youth and team art show in March and submissions to participate in that uh are due on March 7th if there are any teens in your life that have a Crea side encourage them to apply um you can apply through our website and their artwork could be selected to uh be showcased at our community center so I encourage all of our ambitious and artistic teams to take part in any one of these opportunities um we love to have teens involved in the city and look forward to seeing what they can do great thank you vice mayor thank you mayor with February around the corner we are hearing uh Black History Month is coming it's it's a time to honor and celebrate the rich history culture and contributions of black Americans it's an important opportunity to reflect on the past and to celebrate progress you'll be able to find information on community events at chandleraz.gov blackhistorymonth but I want to highlight one exciting event this evening on Valentine's Day you can join South Chandler self-help and celebrate Black love through music at the Chandler Center for the Arts there will be many exciting performances including spoken word live music dance showcases and delicious food it's the perfect opportunity to celebrate Valentine's Day while honoring the beauty and resiliency of Black Culture through the universal language of music so ladies Nodge your guys and let's get down there and have a good time additionally I am pleased to share that nominations are now open for Chandler 2025 disability awareness Awards this is an important opportunity to rec oriz individuals organizations and businesses that are making a significant impact in advancing inclusion accessibility and support for our residents with disabilities nominations are being accepted through January 31st and I encourage you to think about someone or group in your difference in our community that's all I have for tonight mayor thank you thank you I consider myself noted yes noted council member Orlando you know mayor those are all great events but event you really want to be at is on February 8th at the public safety center on 3550 South doson Road yeah we have an upcoming opportunity for our community to learn more about our careers in public safety attendees will be able to learn about valuable available position participate in question answers with our Chandler Police Department team and hear about the benefits of joining the Chandler team or team Chandler excuse me uh I encourage anyone who's curious about a future in public safety we see a lot of young folks out there who may or may know someone who wants to might be interested in attend this event our Police Department is one of the top in the nation because our incredible employees the the blue in you that's our event and opportunity to connect outstanding professionals and learn how you can be a part of the team that makes our community one of the best to call home and you can find that more information on the Chandler a website so that's all I have tonight mayor thank you sir council member Hawkins all right debatable we save the best for last um I wanted to present that there is a daddy daughter dance coming up it's going to take place on Saturday February 8th uh it will be at the Chandler community center right down here from 5: to 8:00 p.m. so this is a really cute event it's for little girls ages 3: to 15 um if Dad isn't available go ahead and grab stepdad uh a fun Uncle a grandpa or even mom if she's available to take the kiddo um you can find out more information and registration on our website and um I think it's going to be a really good time it's going to have not only the dance for the fun music for everybody so Grandpa could get out there and and uh and make a scene if necessary um but there's also going to be contests crafts and dinner
