Andrews here acting City auditor Lake CL here and the clerk is present thank you mayor well thank you uh tonight we do have Scottdale police Sergeant Sean Ryan as well as detective Dustin Patrick and firefighter uh DJ Billingsley should anyone need assistance let's begin with the Pledge of Allegiance I'll call on councilwoman T Tammy kti flag of the United States of America okay well at this uh point in time I do want to draw our attention to the ongoing Wars and War torn foreign countries as they fight for their democracy and freedom also I hope that we will keep the deployed military men and women in our military service in our thoughts and reflection so let's take uh let's pause now on their behalf thank you this month is ovarian cancer awareness month so I do have a proclamation and I do have at the request of uh Rachel Putman and I will read it um uh publicly and she is a Survivor and Advocate uh for awareness of ovarian cancer whereas the American Cancer Society estimates that this year approximately 19,683 death among women and whereas due to vague symptoms and the lack of a reliable early detection test most women are not diagnosed until stage three or later when the cancer has already begun to spread to the lymp nodes and outside of the pelvis and whereas although the fiveyear survival rate for stage one ovarian cancer is over 90% only 15% of ovarian cancers are diagnosed at stage one and the 5year survival rate for stage three is below 30% whereas Medical Specialists across the country are currently conducting clinical trials and research for the time being awareness through education is the best tool for early detection and an increased chance of survival I therefore I David D Ortega 12th mayor Scottdale do declare September 2024 ovarian cancer awareness month in Scottsdale to promote Community Wellness increase awareness of intervention resources and to protect the women we love please come forward Rachel e [Applause] moving on to uh the city manager report I'll call on Jim Thompson thank you Mr Mayor this evening you got a couple items so we're GNA actually I have two videos for you so we'll we'll start the first I'll just let them go this summer recap highlighting projects and events from around the division Indian B wash underpass Project work began in May of 2024 on a new pedestrian underpass along the Indian Ben multi-use path the project will increase safety between Motor Vehicles bike and pedestrian traffic at the busy sherel Road intersection the multi-use path will remain closed at shael road until the project is complete in early 2025 shael Road just east of Hayden Road is now open to vehicle traffic Riata Sports Complex grand opening the brand new 29 acre multi-use facility opened in May 2024 the new complex features five International size lighted soccer fields multi Muse paths a large patio area and restrooms the facility was approved by Scottdale voters in the 2019 fond election Pack 12 baseball tournament Scottdale Stadium hosted the second annual Pack 12 baseball tournament May 21st to 25th the tournament Drew in over 7500 fans from across the nation and concluded with the University of Arizona taking home the title kids Cafe at Civic Center Library in partnership with Scottdale Unified School District the the library system sered nearly 3600 lunches to kids and teens throughout June and July beat the heat scottd Senior Services provided 150 heat relief bags to local seniors in Scottdale this summer the program serves two equally important functions first homebound seniors are provided items to help keep them cool during the summer months Second City staff and volunteers assess the needs of vulnerable seniors and help connect them with local resources Summer Saturdays at Vista Vista Del Camino Community Center offered Dynamic recreational opportunities in June and July to over 100 participants kids and families enjoyed arts and crafts games and more summer reading challenge Scotto Public Library hosted their annual summer reading challenge where over 5 million minutes were read by over 6,000 patrons those registered log their minutes and claim prizes based on how much they read red white and chooo mccor McMan Ro Park celebrated Independence Day with a bang the family event included bounce houses foam cannons a proclamation from mayor Ortega kicking off National Park and Recreation month and fireworks to end the night free learn to swim lessons in recognition of Arizona drowning impact Awareness Month Scottdale potic waved enrollment fees for swim lessons in August over 40 lessons were offered with a total of 25 patrons ages 6 months to adult participating back to school program the annual program helped over 400 families and 950 students prepare for the upcoming school year with school supplies clothes shoes health checks and more little Reader book club the Scottdale Family Resource Center kicked off their little Reader book club a 7-week program that involves sharing and reading books as well as engaging in early learning activities the club was funded through a generous donation from a group of caring people in honor of Scottdale resident and Community Advocate Edmund Richard that concludes our 2024 Community Services summer recap thanks for watching I'm public information officer Kelsey Perry with five fast things happening around the city you need to know at number five it's a shout out to our transportation and streets department for its pavement preservation work this summer despite the sweltering heat Crews paav more than 95,000 square yards of event space out at Westworld and are currently working on improving parking lots and driveways at the fire and police stations at DC Ranch projects like these improve driving conditions and help to extend the life of the pavement coming in at number four it's a big congratulations to Scottsdale's human services department for making this year's annual back toschool program a smashing success the city helped more than a thousand families prepare for the new school year by supplying students with backpacks books clothing shoes and other supplies students also receive free dental screenings food gift cards and more human services staff teamed up with scotdale police the Scottsdale Unified School District and local nonprofits to make it happen for more information head to scottsdaleaz.gov and search back to school program at number three it's an invitation to talk sustainability at two upcoming Community workshops on Wednesday September 11th and Monday September 16th scottsvale is hosting discussions on the city's efforts to become more sustainable and resilient participants will have the opportunity to learn about current projects and share their ideas for enhancing the city's work visit sc.gov and search sustainability initiatives to register at number two we tip our caps to Water Resources executive director Brian beas me who is retiring this month after 12 years at the helm of Scottdale water just part of his distinguished career dedicated to Leading and advancing water initiatives and serving his community Brian leads the city Department responsible for water and wastewater services and stepped up on two separate occasions to serve as Scottsdale's acting city manager the city will initiate a national search to fill the executive director position assistant executive director Kevin Rose will assume responsibility ities in the an congratulations Brian enjoy retirement and at number one it's the launch of the city's brand new college scholarship program Scottsdale promise scholarships are now available for residents or graduates of Scottsdale high schools who have demonstrated Financial need and are attending any of the Maricopa community colleges the funds can be used toward tuition books or course fees and can be renewed for up to four semesters to apply visit scottsdaleaz.gov and search Scottsdale promise always good to measure time in Arizona by the number of Summers we've survived right and we certainly did a lot got a lot accomplished um moving on with the agenda uh during tonight's meeting the council may make a motion to recess into executive session to obtain legal advice on any applicable item on the agenda if authorized by the council the executive session will be held immediately and will not be open to the public however the public meeting will resume following an executive session um also some uh Rules of Engagement per our our Council rules of procedure citizens attending City Council meetings shall observe the same Rules of Order and decorum applicable to members of the council and staff unauthorized remarks uh would um slow things down and would not be acceptable so um we've want to make sure that any violation of the U disruptions would result could result in the removal by security staff additionally this the council recently updated Council rules council members shall not use any electronic communications while attending public meetings other than the electronic devices that we uh Source uh the agenda itself um moving on we will go to public comment public comment is an opportunity reserved for Scottdale citizens businesses owners and Property Owners to comment on non- agendized items that are within the council's jurisdiction advocacy for or against a candidate or ballot measure during a council meeting is not allowed pursuant to state law and is therefore not deemed to be within the council's jurisdiction no official Council action can be taken on public comment and of course there um we allow three minutes to address the C Council um we have one request to speak um and that is um from Lee kofile who uh will come forward and uh happy to see you again Lee all right uh lee CTI uh address is on file um I wanted to come up here and talk about uh sales tax not the prop 490 but just generally wanted to talk about and because uh to put the kind of numbers into perspective so uh let's say hypothetically the council wanted to raise sales tax uh by 0.15% on the citizens for a amount of 30 years and that would raise approximately $1.2 billion if the council were to put something like that on the ballot um I did the math on that with the 240,000 people that live in the city that would come out to be about6 $116 out of each Citizen's pocket but then I thought about some of the other stuff that I've learned coming to these meetings which is we get over 10 million people a year that come into the city spend money and they pay sales tax and so I was thinking that uh that would actually work out to be about $4 a year out of uh everybody that we get here and how fortunate we are and especially like those videos we just watched there are amazing things that the city is able to do to take care of all of its citizens and uh and the people who live here and all the other things we're able to do and so I just wanted to again speaking hypothetically talk about what the impacts would be on the people who visit and uh and what we can accomplish with uh with those uh with that amount um so and then I guess just to follow up also uh property tax which is something only the 240,000 people who live in the city will will pay uh we you you all just lowered that for us by about two three four do or something on average and so for the average citizen that $4 would be canceled out you know so that would be a wash and we'd be able to get all all those extra services and continue to provide for the the our seniors our Citi our children and everybody else who lives here so thank you for your time thank you um seeing no other um members of the public who wish to speak I will therefore close public comment next we'll go on to are unanimous next we will move on to consent agenda items 1- 16 um consent agenda items have a full file and are um duly posted uh there's an opportunity for the um uh public to speak on consent agenda items 1- 16 so at this point I would open uh public comment I see that there's one speaker who wishes to speak on um uh items 12 through 15 and just for the order of things I'm going to ask that we open public comment first and then we'll move on to any questions we may have for councel uh so uh Lee cofle has a request to speak on consent agenda items 12 through 15 please come forward and I think you can summarize in three minutes correct okay thank you Lee again Lee Lee CTI address is on file yeah I didn't I didn't think I needed 12 minutes and they're all kind of on the same thing so I thought I'd just try and get it done in one shot um so the main thing I I was looking at these today I uh am very excited to see that the city is uh getting the grants for all this uh Public Safety information um I think I think it's really important and uh I'm really excited the uh the the questions I had I would guess I was looking for the one comment I wanted to make is on 15 when I was reading the supplemental material it mentioned that during uh uh High uh dur during big events we have the the people the pedestrians can overwhelm the sidewalk and people will walk in the streets and it mentioned increasing enforcement around that time uh to uh on people who are walking the streets rather than sidewalk and I just wanted to say that that uh I'd rather see us maybe shut down a lane to to accommodate all the pedestrian traffic rather than using our uh our police's time to enforce uh any kind of laws around that as far as education I don't have a problem with that the selective enforcement I'm very excited about because you guys uh probably know I I care about uh our vulnerable Road users and and uh this specifically says it's going to go after anybody who is uh speeding uh and driving aggressively which is the number one cause of uh property damage and loss of life and limb is the speed of the driver in the car and uh so that one I wanted a little more information because it mentioned that the areas would be determined later by uh by this Council would would point out where the where the problem areas are and so I'm just wondering how we would uh how citizens could highlight that and then the other two um you know I'm just uh I'm curious about those as well where they both seem to be related to uh intoxication uh and operating these uh heavy vehicles and stuff like that and how we would do that and just uh I know I've gotten up here and said it before I would love to see also maybe increasing public transportation as a way to get people in and out of these very popular areas so that they don't have to drive so they can spend money and then uh and then get out of the area safely both for themselves and all the other V vulnerable people that are out enjoying the city's nightlife which again we get 10 million people who come here a year it's fantastic what we can do and to increase the safety is nothing but a net benefit for us so I am very excited about these grants and thank you thank thank you sir with that I will close public comment on consent agenda items 1- 16 I see a request from vice mayor Graham to uh with perhaps a question go ahead thank you mayor uh just a question um I wanted to question the staff contact for items seven and 11 without I don't want to pull those items seven is for the dog park on Thompson Peak and then 11 is the fire station or uh excuse me fire department warehouse lease agreement so I if if I may I guess we could start with we'll we'll have our staff person come forward Miss timu hi Allison hello um I just wanted to get um what is the status of the pro just kind of just put it in summary the status of the project and um the original budget and where we are today that's really it okay um good evening um council members vice mayor Graham um right now the project what we're requesting tonight is the authorization of the construction phase Services contract the guaranteed maximum price for for that um that price is 5,686 1407 um as far as the budget for the project it initially the bond 2019 budget was 4,637 357 um by a couple of different Council resolutions we added funding we added I think it was 75 5,000 um back on October 24th of 2023 and that was in bond interest uh savings um earnings bond interest earnings and then uh with the uh FY 2324 CIP process as you recall we added General funding um to several projects and this was one of them and that was in the amount of 1 m551 and11 very good and then uh expected date of completion do you do you have that off um our construction schedule is 12 months with anticipate we're anticipating to possibly get done within nine okay thank you Allison sure hello fire chief hello um I just noticed when I was reading the packet uh this is for a 36-month lease and it's talking about the critical necessity of this um lease agreement is that enough time to meet the needs of the fire department uh mayor members of the council vice mayor Graham can you clarify what you mean by that in terms of um the the use of the facility we're ready to move in as soon as uh the gavel drops so clarify is is 36 months enough time for forward for the space that you need it will certainly keep us in in in a place where we can manage our our resources until we can work to find a a more permanent solution okay a 36-month uh lease I think will get us well on the way the capital project schedule and something more substantial we can bring it back to council and then the the packet mentions uh you know added complexities from the ambulance expansion which we're all excited about um how much do you think the ambulance expansion factored into the ne necessity for in a matter of square feet and I'll look at my Logistics folks for a head nod I I would imagine it it can account for probably 5,000 square ft of that of that uh space for dedicated EMS uh supplies storage and management you won't keep any ambulances there on at this Warehouse we won't uh we will uh outfit units using resources from that location however at that location those are my questions thank you fire chief you bet okay councilwoman Janik oh wait Chief go back up sorry you're too quick um briefly could you just explain why we need to rent the warehouse space so that absolutely citizens know what's going on thank you yes uh mayor council member Janet members of the council so as you know uh we've been a fire department for about 20 years now and uh Mr worth and the city did the best they could to bring the fire department into the city's uh normal operations and capabilities way back in 2005 uh but quite literally we simply have overcome the space allotted to us and uh one of the first things that Jen Meers did when she came here was observed that that the city uh has overall logistical uh support needs that uh require her to do her own consolidation and cleaning of house if you will so we had been in U talks for a really several months and frankly years about finding our own space to uh frankly be more efficient recentralize everything because everything is literally strewn out over about 20 distribution locations so this is really about being more efficient with our supplies and resources having greater accountability for those which makes much better Financial sense and then doing a great big favor to the purchasing director and the treasurer in terms of finding Warehouse availability for them that's that's a nutshell of it um but we've got gory details if you need them that's great thank you I appreciate it okay thank you do I have a motion for consent for consent agenda items 1- 16 I make a motion to approve consent agenda items number 1 through 16 second thank you we have a motion and a second uh as far as the Thompson Peak dog park um that's calculated in dog year so that's how we keep track of that anyway we have a motion a a second please record your vote thank you unanimous next we will move on to the regular agenda item item number 17 uh uh concerns infrastructure development agreement we have Brian beaser Water Resources executive director and uh Scott Mars Water Resources planning and engineering director and um also we have we will call for public comment after their presentation go ahead thank you mayor and councel um Brian be Meer Scott still water and actually I'm not going to give this presentation Kevin Rose um my assistant uh executive director um is going to give this because discuss the water we have good bench bench strength and Kevin's more than capable of giving this thank you thank you sir thank you mayor and Council uh what I'll be presenting on tonight is the infrastructure reimbursement agreement with Hayden Loop 101 investors uh reasons for this development agreement uh this allows construction of SE line segments and waterline segments servicing an area you're familiar with north and south of the 101 between Hayden Road and Miller Road alignment uh sides for current in development or and future development uh demands this development agreement allows for new Water and Sewer infrastructure to be constructed and available to serve new developments on an accelerated schedule it is noted that this is part of our iip infrastructure Improvement plan with the uh design start date for these projects uh around 2025 so what we're pushing for is just an accelerated schedule so the first portion is a sewer pipeline it's about 2100 linear feet 18-in pipe it's on male Boulevard between Hayden and Miller Road and it will eventually connect to the mid Road sewer the other segment is the water pot line has multiple sizes it's about 5,300 linear feet and um again it's between the Hayden and Miller Road area and an area as you can see in the map that's a lot of desert so we're trying to get this infrastructure in for the future development so the funding part the um project purpose water and SE capacity enhancements are required to accommodate and develop for development such as ASM Banner Health and other future uh development in the vicinity the source of funding is the water and sewer development fee funds uh this is included in our 2020 2024 and 25 budget with 6.1 for the water and 960,000 for the sewer Hayden Loop 101 investors will construct and fund any cost above the budgeted amount City expenses are cap of this development agreement no budget transfers are associated with this reimbursement and all infrastructure will be designed and constructed in accordance with the AR title 34 requirements so staff recommendation to account to you mayor and councel is adopt resolution 13193 authorizing the mayor to execute infrastructure reimbursement agreement 2024 137 with Hayden Loop 101 investors and the city man or doesn't need to execute any other documents and take such actions as necessary to carry out the intent of this resolution and contract and with that I'll try to answer all the questions you may have sure thank you um at this point I would open public comment on item number 17 seeing none therefore I will close public comment uh we have a um hand up from uh council member Durham wishing to speak thank you mayor um looking at the map there seemed to be one section of it that was going under the 101 and that section yeah yeah that that red section on the top that sort of L I guess they're both L-shaped um I thought there were some kind of issues about rights of way or something of of uh putting pipes under the 101 I think Mr beas Meer discussed that in a previous uh presentation on sewer programs uh Council me member Durham mayor and Council I'll defer to Brian sure mayor and and Council um and council member Durham um yes we we do have restrictions and that is going under existing um sleeve under that 101 yeah to uh and I'm looking over here at Scott Mars already engineering director but it goes underneath the sleeve so we have there are issues we can't get we have certain plans and this was part of our iip to go and use this sleeve under the 101 I if it was outside our iip planning and it was a new segment under the 101 it would be a big issue this we we planned for years ago all right I figured there was a good answer to it thank you in reviewing uh this this is actually a soft dig because we don't have those streets uh and it's an opportune time to put in the infrastructure uh it's also um uh it has subscribers uh that is the parcel owners will be paying their proportionate share and of course the work is being done in a timely in a timely basis so I I do support um this and at the same time I will say this is one of the hottest areas uh for development in really Maricopa County and it was designed with access from the 101 and certainly with the zoning and water uh Provisions that have been um designed the other factor that you'll see there of course is that it does tie into our water and sewer campus which is very essential uh vice mayor Graham thank you mayor thank you for the presentation uh can you go back to the sewer map um Can Can you is that entire green segment is that um what um The Entity the LLC is going to construct and we're going to reimburse them vce mayor Graham Council yes you are correct is there on either side of that or is the city doing any of the construction itself on either side vice mayor Graham mayor council there are other agreements currently going on so those are being done by other developers I would would have to defer to Scott Mars our engineering director Brian bees for more of the history as I wasn't part of that but those are uh current projects going on mayor and Council vice mayor I'm Scott Marge engineering director there's no other City projects with respect to Water and Sewer infrastructure that we're leading in this area it's Optima primarily is the main sewer project that you're familiar with is um so does this connect to the op Optima segment yes it will okay very and that would be obviously to the west of that what about to to the who is constructing to the east to the east is existing sewer lines that will Connect into with this new segment okay very good um this is a little bit hypothetical but the city is aware of upcoming requests for future rezonings and changes and all that we we're just aware of that does this sewer line again to have capacity if there are any changes is is there is there flexibility and the capacity it would be I guess it would be regrettable to build a sewer and reimburse and make a reimbursement and then to find out that it's you know agreed it's not capacious enough Mar mayor Graham mayor and counil defer to Scott to answer that question on the engineering side mayor council vice mayor yes this has been designed for at um for buildout conditions with high density development that's been planned for two years so yes this is expecting high density full buildout when you say high density do you mean what's what's currently zoned in the area even beyond the current zoning we looked through a model at what this could be from Maximum sewer flows and that's what we sized the model for and ultimately the design of these sewer segments did you change your modeling based on um active applications or possible applications as much as they were available at the time two years ago yes we did okay how much per foot do we do you do you think about it per foot or meters as far as reimbursement what kind of segment how do you segment it so the reimbursement is based on the maximum budget we have right now this is looking at about $700 a foot for this sewer if it's a hard dig that could add complications we don't expect that here what do you what how what was the per foot for the axson reimbursement do you remember that what that calculated to I do not recall what the axson reimbursement would be you think it was higher I I I I don't recall because all their information they provided to us was in preliminary draft form we never got to any formal agreements with axon but didn't didn't the count vote didn't this Council vote on the axon reimbursement are you excuse me are you Frank I'm sorry I'm I'm sorry I said axon I meant Optima Optima forgive me um how does this compare to the Optima reimbursement thank you the Optima my apologies to axon our friends at axon vice mayor Graham no problem the Optima sewer is much more complicated it's a much larger diameter sewer there's a lot more unknowns there's a lot of sewer that's in streets when you have traffic control cost jump per linear foot but what would you do do you remember was it twice as much as this I don't have the numbers in front of me but it's certainly much higher per linear foot than this segment will be okay um when do you plan to cut these reimbursement checks for the agreement we have to accept the construction technically we have to inspect it at that point in time we get all their documentation their costs we review it make sure it's it's all acceptable then we would issue reimbursement um if there uh if their cost increase will the city have to potentially have to pay more there's cost incre increases but they're below that cap and our maximum budget if it's acceptable and reasonable we would likely accept it okay would you have to come back to council for above a certain amount I suppose of increase I do not believe we need to as long as it doesn't impact that cap that we've put on this okay thank you Scott for answering my questions you're welcome okay at um any other comment from staff at this point okay so um at this point I would um Entertain Entertain a motion council member Durham thank you thank you mayor I would move to adopt resolution number 139 I'm sorry 13193 second second thank you we have a motion in a second seeing no comment please record your vote thank you we are unanimous approved this point um we have concluded our consent and regular agenda items we will then go on to a public comment a second opportunity for the public to come forward on any non- agendized item there is none therefore I will close public comment uh moving on to item 18 it would be uh receipt of Citizen petitions none has been recorded uh with the uh clerk therefore I will close that item and next we will um move on to number item number 19 it's board and commissions and task force nominations I will turn the meeting over to vice mayor Graham who will be chairing this portion of the meeting thank you thank you mayor it's my honor to chair this portion of the meeting and we want to thank all the applicants for these boards and commissions this evening the city council will be nominating Scottdale residents interested in serving on citizen advisory boards commissions and committees the city of city council is responsible for establishing City policies and enacting laws in support of those policies Council relies on you the volunteer citizen-based boards and commissions to research issues and make recommendations in support of the council's mission and goals information and recommendations provided by city council appointed advisory boards is a valuable tool in helping council members in their deliberations appointments for these positions will be made at a special city council meeting on September 24th as we begin our proceeding this evening I'd like to remind my colleagues that an applicant only needs to receive one nomination in order to advance to interview before the city council when I call on you if your chosen applicant or applicants have already been nominated by a council member please State no additional and we will proceed in the process thank you now let's get started Board of adjustments Board of adjustments is a quazi Judicial body that hears variance requests appeals of the zoning administrator's interpretations and decisions and decides and administrative decisions or zoning requirements which create unnecessary priorities and programs and funding allocations for Scottdale cares Community Development block grants home Human Services emergency and Human Services emergency and general funds terms for Jeff J Jeff Jameson Trisha serin and Neil Sherer expire this fall and they are all eligible for re appointment u j however James Jeff Jameson and Neil Sher have submitted applications and Trisha serin did not there are five five applicants in three vacancies they are Lee kulie Ralph deosta Nunes Pamela hallos Jeff Jameson and Neil Sher and I will start I think I'm with council member Durham at this judicial uh this board makes advisory recommendations to city council regarding the appointment and reappointment of full-time City Judges it has special qualifications the seven member jab will consist of two active judges one one representative from both the State Bar and Scottsdale bar associations and three citizens appointed by the city council who are not judges in any official capacity nor retired nor members of the bar of Arizona susen Galpin tyree's term expires in September and she is ineligible for reappointment Christina Jens resigned from the board in July there are two a public form to hear citizen Grievances and complaints and requests about Transportation matters terms for Professor Kent LA and Carrie wal coxen expire in September Professor La is ineligible for reappointment and Carrie wall coxen is eligible for reappointment and has applied there are two vacancies and six applicants they are Andrew Bridges Kyle Davis Kevin con Consul Carl Stein Carrie will
