good evening everyone welcome to the Gilbert Town council meeting for August 1st 2023. the first thing I'd like to ask you to please do is turn off our silent all your cell phones and devices for our meeting and I will call this meeting to order the invocation this evening will be led by President Kevin Ballard of the Church of letter Jesus Christ of Latter-day Saints welcome thank you for joining us just push the button and turn the mic on please thank you our most gracious Father in heaven we are grateful to be able to walk and talk and see and hear and move about it in this goodly land and grateful for the freedoms that permit us together in such a venue we ask a blessing upon all those that serve our community from our military to our Armed Forces to our fire and police departments and to our city council we thank them and please bless them for their willingness to serve and share may we as a community live in harmony and according to Thy word and deed bless us Father in Heaven that we can look outward and not inward and father at this time we especially ask for moisture we are grateful for that which has fallen we continue asking leave for rain and moisture in this southwest in the name of Jesus Christ amen amen thank you president Ballard thank you for asking for rain the much needed monsoon season next we'll have our Pledge of Allegiance led by councilmember Buckley please please rise I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all thank you if I could please have town clerk Herrera conduct the role mayor Bridget Peterson here vice mayor Kathy tilkey here council member Scott Anderson here council member Chuck bongiovanni here council member Bobby Buckley here council member young kaprowski here in council member Jim Torgeson here Quorum is present thank you chevelli now we'll move on to we don't have any presentations and proclamations this evening so we'll move to Communications from citizens vice mayor I pass to you thank you mayor good evening the Gilbert Town Council values citizen comments and input anyone wishing to speak before the council must fill out a request to speak card for each item they wish to speak on and submit it to the town clerk or place it in the bin provided prior to the start of the meeting the communications from citizens portion on the agenda provides citizens an opportunity to identify for the Town Council matters of Interest or concerns related to town government that are not on the printed agenda under the provisions of the Arizona open meeting law the Town Council is prohibited from responding to issues that have not been properly noticed therefore the Town Council may only listen to citizens who wish to address them on non-agenda items at the conclusion of the open call to public response is limited to individual members of the council responding to criticism made by those who have addressed the public body asking staff to review a matter or asking that a matter be put on a future agenda the town asked that when your name is called you come forward to the podium state your name and place a residence and then begin speaking all speakers are expected to observe common standards of decorum and courtesy personal attacks political speeches or threats of political action are inappropriate in this form and will be grounds for ending a speaker's time at the podium the first person that comes forward you'll need to press the button on the bottom and you'll note that the microphones on when you see the little red light here each person to come forward will have three minutes and there will be a clock that will show not only on your screen but the screen for the audience as well with that um hold on just a second I'm trying to group these by topic okay thank you um our first speaker is Lonnie chisen or chisen I'm sorry if I oh you did yes you did Chisholm there it is thank you thank you very much come forward and we'll give you three minutes right on the bottom of that black you see where the microphone yeah there you go bingo Lonnie chisen town at Gilbert Gilbert is one of the most sought after places to live in this country the current perception of this town's dysfunction has clearly displayed in news article after news article has become a major hindrance to the health and well-being of the town the leadership within this body of representation is doing harm to the value of Gilbert thank you thank you very much learning next up is Daniel Strazza and I'm following Daniel will be Brandon riff is Daniel here oh there you are foreign Gilbert resident nice to see you all thank you for having me I'm only here because I feel like I would be doing the town of disservice if I didn't exercise my civil Duty since Bridget took office there have been at least nine ethics complaints maybe 12. I'm not sure math wasn't my strong suit but what I do know is that anyone else conducted themselves in the way that the mayor has they would have been relieved that their duties and responsibilities immediately so why do we still have a mayor that is destroying this beautiful city there is very little that you have done to this town or for this town this city that the constituents are happy with that's why we moved here it's a beautiful town that resembles most of what Gilbert is known for there are apartments and industrial buildings now on every corner you're pushing a rail station in Coulee that honestly I've never heard one positive comment from any Resident of Gilbert talk about but these are just to name a few as my time here is limited but aside from the political corruption and under the hand table handouts or payback favors or whatever you have to do your conduct has been a complete embarrassment to the town and frankly going to end up being a huge waste of tax dollars it's absolutely shameful and embarrassing as a Gilbert taxpayer I certainly don't want my earn money being used to defend a mayor Whose actions don't align with the values of this town we need a mayor to lead not shut down people not kick people out of meetings not violate people's rights but hear people and understand people the best leaders of this country the best companies around the world have a team behind them of people that respect them and understand them and there's there's conduct that goes back and forth and that's what we're missing here in this town so I hope everybody takes that into light and knows the next time we have to vote we vote the right way thank you thank you Daniel Brandon riff who will be followed by Ryan handelsman good evening people are laughing at us they're laughing at how screwed up things are in this town all the web websites all the newspapers news stories it's pathetic it's it's disgusting I'm embarrassed when the mayor gets an Ethics complaint and she's had a lot of them she calls it an abuse of the process that people use to attack her but then the mayor goes and does the exact same thing abusing the ethics complaint process to attack a fellow council member the first mayor in Gilbert's history to do such a thing congratulations so why did the mayor file on ethics complaint against another council member uh well she heard the council member called her a mean name are you serious a formal ethics complaint because someone expressed their negative opinion of the mayor grow up nevertheless the mayor retaliated and used ethics complaint process to shut him up depriving him of his rights under the First Amendment and embarrassing our entire town along the way I'm here tonight because I too once attempted to express my negative opinion of the mayor likewise the mayor retaliated I didn't get an Ethics complaint but she did order the SWAT team to remove myself and others from a public meeting just to shut us up what happened to my ethics complaint well nothing because the town hired attorney William Sims to conduct a fake phony so-called investigation where he interviewed only one side and not the other before fleecing the town for over 13 000 taxpayer dollars in exchange for sweeping the mayor's misconduct under the rug it seems the mayor will do anything to silence anyone who dares to express a negative opinion to her on the other hand the mayor thinks that she can go on record expressing and disseminating materially false statements about me a private resident in order to impugn my character and my professional reputation finally as we walk down hypocrisy Lane I'd like to point out one more thing the mayor claims the current ethics complaint process is being weaponized and must be overhauled yet when given the choice to either wait a couple of weeks for the new ethics complaint process to take effect before filing her complaint or filing it right now under the current process as a weapon the mayor herself chose the weapon leadership starts at the top and our mayor has repeatedly failed our town and every resident who lives here with this childish behavior it's got to stop it's got to stop mayor Peterson I believe that you lack the Judgment emotional maturity and character to lead our town I respectfully strongly urge you to step down and walk away thank you thank you Mr Roof next is Ryan handelsman Ryan handelsman town of Gilbert honestly I feel like I'm watching my high school student government conduct business lately and whether that or an episode of The Office although this Deus has been riddled lately with sophomoric Behavior the manifestation again starts with You Bridget I'm curious if you can even explain how any of your conduct demonstrates leadership you go to ribbon cuttings you go to Lemonade Stand that's all find well and good but that does not constitute a leader for example you went on record and during a council meeting and told another council member you didn't know he could read couldn't read a budget and was surprised because you thought he owned a lot of businesses how does that bully-ish behavior reflect leadership he also literally walked out of a council meeting to go grab a Diet Coke while a citizen was addressing the council during Communications from citizens that's leadership you had me forcibly removed amongst others because I was sitting in the back of a room holding a sign that says stop lying and after you kick me out all that was I asked for was an apology an apology yet you failed to respond you ignored it but unlike others I don't succumb to bullies and since the only thing that seems to attract your attention is Drama We slapped a one million dollar lawsuit on it to get your attention and that's leadership I guess right your accusations of people weaponizing the ethics complaint process meanwhile this is exactly what's going on now I find it highly ironic that all of the ethics complaints that just happened to be mustering up lately are people that have outspoken against you or potential opponents in the next mayoral election that's leadership but here's the peace to resistance a little rhetorical scenario here a police officer goes to a scene for a domestic dispute between a husband and a wife only interviews the suspect but not the victim and deems the incident to be inconclusive and even go so far as to agree with the suspect as to why he attacked wouldn't that raise your index of Suspicion I ask because the town like Brandon said hired attorney Bill Sims to investigate an Ethics complaint regarding the whole sign incident his report included multiple reference of You Bridget communicating your side of the story to Mr Sims meanwhile he never contacted me or any of the victims or anybody else involved in the process so you as a leader received that report from Mr Sims and felt that was a fair outside investigation that's not a leader I feel that you're unfit to be the mayor of this town you're at your tactics are predictable you're probably going to give us some sort of speech at the end of all this and maybe even find a way to muster up a few tears we're not fooled we've seen this episode it's getting old please step down thank you Ryan next up is Terry Natty and following Terry is Ann Andrew Adams hello my name is Terry Natty and I live in a county Island within the Gilbert planning area first of all I really dislike it when people make assumptions especially about my motivations without asking me I am an open book if you want to know about me ask I want to make it abundantly clear that my ethics complaints have nothing to do with any other ethics complaints that have been filed recently I first filed with the AG's office on June 29th and June 30th and I copied the town clerk the same day in each case this was well before I knew about anything any other complaints there are a few main motivators of people Faith and family are awesome however money and power often big motivators council member koprowski intimated to me in an email that her income from the town had significantly diminished after being appointed to council to approximately one percent of her company's Revenue but had not stopped um so obviously money is not a motivator for her think about that when I emailed a group of friends neighbors and acquaintances regarding the ethics complaints against council member caprese I got feedback from a few sources the first was a neighbor who does not work in the engineering field but knows someone who does you councilmember koprowski were a topic of conversation with someone within the engineering world to someone outside the engineering world the discussion was based upon the perception of shady dealings on your part I do realize that perception may not be reality but is often rooted in reality I also had a random stranger reach out to see how they could help in pursuing complaints against you thus individual per their profile on Facebook is an engineer by trade it also brought up a story from a different Source about a certain assistant being terminated because their spouse sold t-shirts to the town at cost now I don't know how many t-shirts there were but there would I would be willing to bet it was less than ten thousand dollars worth so please tell me how what I found isn't an Ethics violation in at least one Arena if the T-shirt story is indeed true maybe I should find that person and suggest that they file a suit against the town for wrongful termination I mean at this point in time what's one more lawsuit you're only spending taxpayer money not your own on July 27th I did ask Town Council and management to hold and or postpone addressing my complaint of Ethics my complaint of Ethics violations against council member koprowski based on language for a new code depending on the outcome of this session and subsequent voting postponing the requests could save the town and its taxpayers twenty to forty thousand dollars in investigative fees I abhor waste and Reckless spending it is in that spirit that I was I requested the hold also interestingly I'm out of time thank you thank you Miss Natty um Andrews next and following Andrew is Amy Holman hi cancel uh thank you for taking the time to hear me out tonight so my name is Andrew Adams I'm the chairman of the ld14 Republican party and I come here tonight to speak in support of councilman Torgeson Buckley and Bon Giovanni we're proud of their performance on the council since they've been elected and we're honored that there are our councilmen so I come here tonight because I've read recently in a public press release that there are ethics complaints being lodged against Bobby Buckley and Jim Torgerson according to these public press releases there are many errors in these press releases they're either untrue or completely unfounded accusations against both the legislative district and in my opinion the councilman reading this I can't help but think that these particular ethics complaints seem to be an act of Vengeance of some kind because of the length this person went to fabricate parts of their claims so I'd hope you take that into consideration while you're reviewing this and thank you for hearing us all out tonight thank you Mr Adams we have Amy Holman next and following Amy will be Jennifer Watkins okay before I say anything I do this with great trepidation I fear that I may have to deal with retaliation but if it wasn't for the brave people before me there would be nothing but corruption with that being said my very first dealing with this government body I was shocked with the unprofessional and aggressive manner that I received when the mayor was first inducted I emailed her discussing my disapproval of the apartments that were going up she blatantly lied and told me that this was in the town plan that was voted on years ago and that I basically had to suck it up well I went and I looked up the town plan this was untrue uh if these projects were actually in the town plan there would be no need for the yellow signs everywhere and all the zoning variances that are on them it was a flat out lie then as time went on the numerous Shady deals and that behind the door meetings made my opinion even worse thankfully we were able to vote in three people who are here for the town and not in it to increase their own wallets unfortunately for the town of Gilbert it's already too late the prior Council and the mayor were able to get in enough Apartments zoning changes Etc to destroy this town my house backs up to a major road when I first moved here the traffic was quiet like the lull of an ocean now there are souped-up cars speeding down as if they're in a race huge enormous trucks rattling by and the amount of emergency vehicles Blowing by hour by hour is outstanding graffiti has increased crime has increased and the quality of life for a Gilbert resident has decreased the mayor in the shenanigans are in the news all the time and rather than from learning from it and listening to her constituents she files ethics complaints on other council members as retaliate retaliation this is how a petulant child would act uh this rather than a respectable mayor she allowed a council person koprowski to have multiple contracts with the town rather than be putting out for public uh evaluation these are not the actions of an ethical honorable and respectable mayor we can do better thank you Amy Jennifer and following Jennifer will be Tammy Foley hi thank you for hearing me my name is Jennifer and I am a resident of town of Gilbert probably should have looked at the agenda completely out of left field different from what's being talked about so maybe this will be a nice change of pace um I live in the gardens neighborhood off of Recker and Ray and there's Community concern about the parking that's going on on the circle currently the straight edges are parking allowed both sides and the curves are no parking allowed and when turning onto the garden Circle parking on both sides creates limited visibility to see around the corner leading to cars creeping forward into the road and difficulty Crossing for pedestrians when you do turn onto Garden Circle and manage that parking on both sides creates a one-way traffic situation of cars waiting to let each other through this is very difficult as it's directly after the turn into the neighborhood then when you factor in the size of Emergency Response Vehicles industrial Vans and trucks school buses delivery vehicles the roads become even more impassable being able to see buses stopped around the corner or children already six feet into crossing the road after school or emergency responders is important for obvious reasons so I don't need to go into that so basically I'm here to help ask for your help in resolving this as a community we've brainstormed three options that we think are pretty gung-ho easy first we were recently informed by an officer that they no longer ticket on the rounded Corners that are no parking right now because sometimes we're removed and so judges won't enforce because of the lack of signage so the first obvious step is just to re-establish adequate signage um second we believe that the difficulty in Crossing and turning at intersections could be solved by just extending the Red Zone that's on either side of the stop signs um this would provide easier sight lines as well as possibly considering three-way stops to enter the circle third if the city does choose to re-survey the road and measure and see what's allowable which I hope they do at varied times of day during different days of the week and find that two-sided parking is unrealistic as it is now that perhaps one-sided parking could be considered for the road some parking is absolutely necessary the neighborhood on the Northern end is garage only so it we have to have parking but parking on the inside of the circle can become problematic with bus stops so thank you for hearing me out sorry to kill the vibe in here but hopefully I was able to give a clear mental image and make some sense and thank you thank you Jennifer um up next is Tammy hi I'm tamiri I also live in the gardens um a neighbor of was it Jennifer okay so I'm also here about the parking but for a couple of different issues that I wish would be on a future agenda if I would chime in one thing that I've seen in this meeting is that we came to a city council meeting it was my first one ever and I've never ever been to a city council meeting that didn't have an agenda so something tells me that there's something to miss I think you all need to just pray about it and just seek maybe some fellowship over lunch or something find some commonality find some team building time and figure out what it is you should be working on because we should never have an empty agenda okay so now regarding the parking thing I would like to see if it could be on a future agenda that we would take a look at the use of tag readers for enforcement of parking in our community I think it is against many um morals and standards that most of us believe in we are all Property Owners on this property and recently a company out of Texas has been employed employing a tag reading tow company and there isn't sufficient signage to meet the state ARS codes for that type of parking enforcement which would require that they tell you who is the person going to tell you how much is it going to cost and what are the violations the times of day and all of that so there have been many people crying and sobbing and we have not gotten proper notification we do deal with an HOA but my concern is is it even legal to use something that was intended to do Towing for a repossession to just do Common Parking Enforcement and we have now pimped out our neighborhood so to speak because we're talking 300 no it's not funny I'm serious it's 225 to 550 dollars for one tow depending upon the size of your vehicle that seems like a pimp to me and they don't have any Mercy if you come out if let's say you had an essential service at your house to do therapy physical therapy medical therapy or delivery house cleaning realtor showing a property they will tow you because you don't have the signage up to be able to prevent it there's not even a way to prevent it if you're one of those essential services or other you know Common People in the neighborhood it's 24 7 enforcement if there's any way that we can get it on the agenda I would be happy to put together a proposal to help eliminate that type of enforcement oh and as far as the garden circle is concerned I concur with the idea that we take the Outer Circle and prevent parking on that make it all Red Zone from The Windsor stop sign to the next stop sign for to the I guess that would be to the South if we just cleared up that path and we kept City parking available on Orchid which is the entrance to the gardens that would alleviate a lot of the stress keep our community safe so that people could have their children cross safely to the bus stops thank you Tammy um Judy or somebody perhaps you could get her our agenda maybe there wasn't one available out there because oh thank you thank you Chief just so you'll have a copy of the agenda for tonight and I was wondering if either Chief Solberg or somebody from Jessica's team will vice mayor Chief and Jessica will follow up thanks I was just going to ask if they would follow up with them thank you um I think as I mentioned at the beginning of the meeting that Arizona law does not allow us to comment or interrupt a comment by state law which was recently passed and so um there is an opportunity to um respond to criticism which I was just going to look okay council member Kapowski thank you in response to the criticism by Miss Terry Natty I'd just like to clarify that the conflicts of interest that I have as a business owner have been properly identified disclosed and disqualified but I'm committed to continue serving in the best interests of the public and making decisions that benefit the community as a whole and not for personal gain I also support improvements to the council's conflict of interest policies and procedures ensuring greater transparency and accountability thank you thank you um any other comments before we close this okay with that mirror we are done with the communications from citizens and then we will move on to the consent calendar and right back to you by spare thank you mayor there has been no request to pull any items from the consent calendar and therefore I'll make a motion to approve items number one through 27 to approve those I have a motion can I have a second please I'll second that motion by vice mayor telkey seconded by council member Bon Giovanni please vote motion passes 7-0 moving on to our public hearing portion of our agenda we have four items on our public hearing all items will be heard at one public hearing at which time anyone wishing to comment on public hearing items May do so vice mayor do you have any slips for public hearing items I do not I believe there was one online comment there were two public comments I'm going to open the public hearing two public comments received online for item number 30 both people were opposed to that item on our agenda we have four items liquor like two liquor licenses code of Gilbert boards and commissions and fees would anyone like to have any of these discussed separately seeing no I will go ahead and close the public hearing and if anyone would like to make a motion on all four of those I'd be happy to accept that mayor I'll make a motion to approve the public hearing items 28 29 29a and 30. thank you can I have a second hi second I have a motion by vice mayor telkey seconded by council member excuse me council member Buckley please vote motion passes 7-0 moving on to our administrative items for this evening we have the council Administration item is the council meeting schedule calendar for 2024. I have just one comment we would like to go back to doing student of the month in person starting in September and our meetings typically start at 6 30 and I'm wondering if we want to start student of the month at 6 30 or would we it typically takes about a half an hour once we get in the flow and get no rhythm I know councilmember Anderson and I are the only two that have done student of the month in person or would we like to start student of the month at six with the scheduled with the council meeting starting at 6 30. looking for some feedback um I'd recommend six o'clock um I've been on the receiving end of sitting in the audience and waiting for this meeting to get going and it really does extend the evening and I think it also helps getting the kids home for their homework I'd like to start that at six also and I'd like to suggest that we bring Gilbert digital in to give these kids a little bit of time on our social media platforms because that's good for building the communities to highlight these kids that have achieved something and deserve some recognition publicly so the way that we're sorry council member I agree with both council members the way the last time we did an in-person student of the month it was February of 2020 and at that time the photographs were being done by the mayor's aide and they are automatically uploaded to the top they were at that time uploaded to the town's Flickr account and the town's Facebook page would that suffice that's what we were doing at that time plus parents are always invited down to the front to take their own photos and we do a group photo of everybody too so the way that this would work is then the six o'clock meeting would be listed as a student of the month ceremony at 6 PM noticed that all council members could be in attendance with our regular meetings starting at 6 30. and those nights are already denoted on the calendar with an asterisk if you didn't know just in case you didn't notice does that sound good okay then if anybody would like to make a motion to approve the calendar for 2024 I would gladly accept that Soul move thank you second I'll second I have a motion by councilmember Anderson my aide Kirsten yes thank you moving on to boards commissions and committees reports from console Liaisons July has been kind of a quiet month I don't know if anyone has anything seeing none moving on to Communications report from the town manager he's joining us virtually I believe yes good evening good evening thank you mayor nothing tonight oh thank you hope you're feeling better thank you thank you report from the Council on current events again yes councilmember Anderson yes um I'd like to make a few comments uh that I guess are related to the current events um I have been very concerned of late and as we've heard tonight that from the general public that we are struggling and we're trying to do our best but we're at a point where contention is something that's going to destroy rather than build up this community which is the most important thing to me I I'm very concerned that I wasn't as concerned with the uh the well the number of Ethics complaints that have come in here recently I did I wasn't that concerned until the final one that was just recently submitted which charged the entire council with being in violation of our ethics on policy and that concerns me a lot and disturbs me a lot and I think we need to understand that this community right now is at a point where we need to um address and as was said in the prayer at the beginning look outward don't look inward for a couple of reasons we need to do this um first of all as everyone knows we're nearing build out in Gilbert and as we near build out it's there are going to be critical decisions that we're going to have to make and if we're spending our time trying to address complaints and lawsuits and what have you we won't be able to address those critical items we have a an initiative called the city of the future and we have certain metrics that we want to watch very closely and if our attention is taken away from that we have the potential to become no different than any other community around us if you see the natural progression in Phoenix and Mesa and some other cities that it begins to deteriorate over time if you don't pay attention and and address issues as they come along that's the first thing that I'm concerned with the second is i i in another part of my life work for a company that dealt with land acquisition and development and I was I was responsible for doing due diligence for that company and if you think that there isn't a line item under due diligence about political stability in the community go back and look through some of those due diligence lists it's there and when a company is looking to locate into a community a thriving Community like Gilbert that that is an issue that they are concerned about and that would hurt us again economically and in so many other ways I'll end just by saying that I believe that contention we're going to need innovative ideas and as we go towards the completion of build out and contention will never lead us to innovative solutions contention will just lead to more contention and I hope that we will listen to what was in the prayer tonight about looking outward not looking Inward and to be true Servants of this community thank you mayor thank you councilmember Anderson any other comments from council members um report from the mayor and current events to Morrow evening we will be hosting a an open house for any teens that are freshmen through seniors interested in potentially joining the mayor's youth advisory committee the application is open until the 5 PM on August 5th but we'd love to have you come down to the open house right here at Town Hall 50 East Civic Center Drive at 6 pm on August 2nd and in closing for my comments I will say happy 100th anniversary to Gilbert Fire and Rescue Department congratulations on a hundred years I was out Saturday for the celebration and um somebody mentioned when we actually switched over from Rome Metro to to our own private fire department here in the town of Gilbert and that was in about 1993 or 1993 but the but the department started here in the town of Gilbert in 1923 so congratulations Chief I see at least one of our assistant Chiefs back there congratulations to your whole department and I know that you're also hitting one year on the ambulance service here in the town of Gilbert so thank you for that congratulations and thanks
